Board NAC 631 Regulations
The Board's Nevada Administrative Code (NAC) regulations move through a public rulemaking process. The brief description below is intended to provide a basic description of the process. Please visit the Nevada State Legislature for more specific information on the rule making process.
Adopted Regulations
What it means: The Board has taken formal action to adopt the regulation after the required public process.
When it becomes effective: A permanent regulation generally becomes effective when it is filed with the Secretary of State (as handled through the Legislative Counsel filing process), unless a later effective date is specified in the regulation.
Pending Regulations
What it means: The regulation has typically been adopted by the Board, but is not yet final/effective because it is still in the State’s review and filing steps (for example, review by the Legislative Commission or its Subcommittee and/or filing with the Secretary of State).
Status: Pending regulations should be treated as not yet in effect until the regulation is approved/processed and an effective date applies.
Proposed Regulations
What it means: The Board is considering new or amended regulation language and is completing required public notice and public meeting/hearing steps.
Status: Proposed regulations are not yet effective or enforceable. They may change based on public input and Board action.
Emergency Regulations
What it means: Emergency regulations are used when immediate action is necessary under Nevada’s administrative procedure laws.
When it becomes effective: An emergency regulation becomes effective when the agency files the emergency regulation and required informational statement with the Secretary of State (and also files a copy with the Legislative Counsel).
